Manama, February 1 (BNA): In collaboration with the Information and E-Government Authority, Nayef Khalifa Al Tawadi, Assistant Under-Secretary for Legal Affairs and Enforcement at the Ministry of Justice, Islamic Affairs and Endowments, announced that starting on Tuesday, February 3, unfunded Cheques can be executed via the “Publishing Execution Files Using Administrative Documents” service on the Bahrain National Portal (bahrain.bh). Cheques with insufficient funds to be enforced online via Bahrain.bh without lawsuit
Al Thawadi clarified the issuance of Ministerial Decision (6) of 2026, which governs the policies and processes for enforcing Cheques that are returned due to insufficient amounts. There is no need for a court challenge because it treats the check as an enforceable document under the revisions made to the Commercial Law. A 2% enforcement fee on the check amount, up to a maximum of BD 1,000, is required for enforcement. When the enforcement request is opened, the fee is automatically collected.
He continued by saying that the ruling outlines the paperwork required to approve an enforcement request, such as: A bank statement attesting to the lack of funds, a clear copy of the Cheque from both sides, a power of attorney, if applicable, a notice to the drawer to pay, and payment of the necessary fee. If the requisite documents are not given, the request will be refused and the fee will not be returned.
The objectives of this new rule are to enhance the effectiveness of enforcing rejected Cheques, boost trust in Cheques as a means of payment, safeguard the financial rights of creditors, and promote stability in business and civil transactions.
